Terms of Service.
The rules of the road for using App Vitals and Vitals OS. Plain English, no surprises.

Section 1
The service.
App Vitals is the consulting business that operates this marketing site at app-vitals.com and publishes Vitals OS, the scheduling and engagement platform available at vitals-os.com. These terms govern your access to and use of both the App Vitals website and the Vitals OS application (together, the "Service").
By accessing the Service, creating an account, or otherwise using any part of it, you agree to these Terms of Service. If you do not agree, do not use the Service. When this document refers to "we," "us," or "our," it refers to App Vitals acting on behalf of both the App Vitals consulting business and the Vitals OS application.
Section 2
Acceptable Use.
You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of it. You may not:
Use the Service for illegal activity — including fraud, harassment, distribution of malware, or anything that violates applicable laws or regulations.
Abuse or disrupt the Service — including denial-of-service attempts, automated traffic that exceeds reasonable limits, or actions that degrade availability for other users.
Scrape or bulk-extract data from the marketing site or Vitals OS without our prior written permission. This includes crawling beyond the bounds set by robots.txt and harvesting content for redistribution.
Reverse engineer or tamper with the Service — including decompiling, disassembling, or attempting to derive source code, except where such restriction is prohibited by law.
Circumvent security or access controls — including probing for vulnerabilities, attempting to access accounts that are not yours, or bypassing authentication or rate-limiting mechanisms.
Section 3
Your obligations.
Account security. You are responsible for safeguarding the credentials used to access your Vitals OS account and for any activity that occurs under your account. Notify us promptly if you suspect unauthorized access.
Accurate information. You agree to provide accurate, current, and complete information when registering for and using the Service, and to keep that information up to date.
Lawful content. You are responsible for the content you upload, create, or transmit through Vitals OS. You agree not to use the Service to store or distribute content that is unlawful, infringing, defamatory, or otherwise objectionable.
Third-party services. When you connect a third-party service to Vitals OS — for example, Google Calendar — you must comply with that provider's terms of service in addition to these terms. You are responsible for any consequences of disconnecting, revoking, or losing access to a connected service.
Section 4
Intellectual Property.
Our IP. App Vitals owns all rights, title, and interest in the marketing site at app-vitals.com, the Vitals OS software and platform, and all associated trademarks, logos, written content, and designs. Nothing in these terms transfers any ownership in our intellectual property to you.
Your content. You retain ownership of the scheduling, invoicing, engagement, and other content you create within Vitals OS. You grant us a limited, non-exclusive license to host, store, and process that content solely as needed to operate the Service for you.
Feedback. If you send us suggestions, ideas, or feedback about the Service, you grant us a perpetual, royalty-free right to use that feedback to improve the Service without obligation to you.

Disclaimers.
As-is
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim all warranties — including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not warrant that defects will be corrected, that any data will be preserved indefinitely, or that the Service will meet your specific requirements. You use the Service at your own risk.
Section 6
Limitation of Liability.
To the maximum extent permitted by law, App Vitals and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost revenue, lost data, or business interruption — arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
Our total cumulative liability for any claim arising out of or relating to these terms or the Service will not exceed the greater of (a) the total fees you paid to App Vitals in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the smallest amount permitted by law.
Section 7
Governing Law.
These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. The exclusive venue for any dispute that is not subject to arbitration will be the state or federal courts located in San Francisco County, California, and you and App Vitals consent to personal jurisdiction in those courts.
Arbitration. Any dispute arising out of or relating to these terms or the Service that cannot be resolved informally will be settled by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted in San Francisco, California, in English. Each party waives any right to a jury trial and the right to participate in a class action against the other party.
